The Civilian Agency Acquisition Council and the Defense Council published a final rule amending the federal acquisition regulation (FAR). As a result, all government contractors and subcontractors are required to have and comply with an ethics program in order qualify to be awarded government contracts.

Issued in September 2005, this ABC report, Quality Public Construction at the Best Price: A White Paper on Negotiating Effective Procurement Policy, addresses the policy debate surrounding criteria established by government entities that limits competition for public construction projects. While criteria can be touted as “best value” it is important to understand the benefit and drawbacks of any criteria that limits competition.
