Trump Administration Releases Spring 2019 Regulatory Agenda

On May 22, the Trump administration released its Spring 2019 Unified Agenda of Regulatory and Deregulatory Actions. WOTUS Revision Would Alleviate Confusion, Says ABC in Comments to Agencies

On April 15, ABC submitted comments expressing its support for the U.S. Environmental Protection Agency and U.S. Army Corps of Engineers’ proposed rule revising the definition of “water of the United States” under the Clean Water Act. EPA and Army to Host Public Hearing on New WOTUS Proposal

The U.S. Environmental Protection Agency and the U.S. Department of the Army announced plans to host a public hearing on the new “Waters of the United States" proposed rule in Kansas City, Kansas, Feb. 27-28. ABC Welcomes EPA’s Newly Proposed WOTUS Rulemaking

On Dec. 11, the U.S. Environmental Protection Agency and U.S. Army Corps and Engineers jointly issued a proposal to revise the definition of “waters of the United States” to clarify federal authority under the Clean Water Act. The proposed rule seeks to provide businesses and landowners with clear definitions of what are and what are not ‘navigable waters.’ ABC President and CEO Michael Bellaman attended the signing ceremony for the rulemaking at the U.S. EPA. ABC Supports EPA’s Affordable Clean Energy Proposal

On Oct. 31, ABC submitted comments to the Environmental Protection Agency in support of the Affordable Clean Energy proposed rule, officially titled Emission Guidelines for Greenhouse Gas Emissions From Existing Electric Utility Generating Units; Revisions to Emission Guideline Implementing Regulations; Revisions to New Source Review Program. If finalized, the ACE rule would replace the Obama administration’s Clean Power Plan with revised emissions guidelines, propose new regulations to direct both EPA and the states on the implementation of emission guidelines and revise the New Source Review program.  Read the rest of entry »

The Latest on WOTUS: Legal Action and Upcoming Rulemakings

In February 2017, President Trump signed an executive order directing the U.S. Environmental Protection Agency and U.S. Army Corps of Engineers to review the 2015 final Clean Water Rule: Definition of "Waters of the United States," also known as the WOTUS final rule, and accordingly revise or rescind it through public comment. EPA and NHTSA to Hold Public Hearings on New Fuel Standards Proposal

On Aug. 24, the Environmental Protection Agency and National Highway Traffic Safety Administration published an announcement of public hearings on the joint proposal “Safer Affordable Fuel-Efficient Vehicles Rule for Model Years 2021-2026 Passenger Cars and Light Trucks” in the Federal Register. The SAFE Vehicles proposed rule would amend certain existing Corporate Average Fuel Economy and tailpipe carbon dioxide emissions standards for passenger cars and light trucks and establish new standards for model years 2021 through 2026. Trump Administration Proposes Revisions to the Endangered Species Act

On July 19, the U.S. Fish and Wildlife Service and National Oceanic and Atmospheric Administration's National Marine Fisheries Service proposed revisions to regulations governing sections 4 and 7 of the Endangered Species Act.
