On June 18, 2024, the U.S. Treasury Department’s Internal Revenue Service announced a final rule that will require private developers to follow controversial project labor agreement, prevailing wage and apprenticeship policies when building clean energy projects and seeking more than $270 billion of enhanced tax incentives via the ABC-opposed Inflation Reduction Act. The final rule takes effect 60 days from when it will be published in the Federal Register on June 25, 2024. Read ABC’s statement opposing the final rule.
Throughout the rulemaking process, ABC, which opposed the partisan Inflation Reduction Act passed through budget reconciliation, called on the IRS to provide further clarity and withdraw anti-competitive aspects of the proposed rules that would encourage PLAs, increase costs, reduce competition and delay construction of clean energy projects.
ABC general counsel Maury Baskin will provide an overview of the final rule’s anti-competitive provisions and discuss its challenges for stakeholders and opportunities for ABC member contractors and chapters with government-registered apprenticeship programs.
