Obama Renominates Unconstitutional “Recess” Appointees to NLRB

President Barack Obama Feb. 13 nominated Democrats Sharon Block and Richard Griffin to the National Labor Relations Board (NLRB) – only a few weeks after an appeals court ruled their 2012 recess appointments were unconstitutional.

ABC, who leads the Coalition for a Democratic Workplace (CDW), the group that initially issued the legal challenge against the recess appointments, expressed disappointment in the action.

“It’s becoming clear that this administration is more interested in playing politics than seating a qualified, impartial slate of board members,” said ABC Vice President of Government Affairs Geoff Burr.

The same day, ABC also called on Congress to limit the board’s power to issue new decisions and to prevent it from enforcing decisions dating back to the unlawful recess appointments in response to a U.S House of Representatives subcommittee hearing.
