Congress Passes Year-End Tax Compromise, Delays Spending Cuts

Both the U.S. Senate and the U.S. House of Representatives Jan. 1 passed legislation to permanently extend Bush-era tax policies for most income levels, softening the blow of the fiscal cliff after allowing individual rates to expire for nearly 24 hours.

ABC Supports Waiving Davis-Bacon on Superstorm Sandy Relief Efforts

ABC Dec. 27, 2012, supported an amendment offered by Sen. Rand Paul (R-Ky.) to H.R. 1, which is the vehicle for Superstorm Sandy supplemental appropriations, that would have waived the enforcement of Davis-Bacon Act requirements for projects funded under this legislation. The amendment failed 42-52.

Treasury and IRS Issue Proposal on Employer Requirements in Health Care Law

The Department of Treasury and the Internal Revenue Service Dec. 28, 2012, issued a notice of proposed rulemaking addressing the employer requirements contained in the Patient Protection and Affordable Care Act (PPACA), which is scheduled to take effect Jan. 1, 2014.

First Refusal Rule on Service Contracts Act Effective Jan. 18

The Department of Labor (DOL) Wage and Hour Division Dec. 21, 2012 announced the rule implementing Executive Order 13495, or Nondisplacement of Qualified Workers Under Service Contracts, will become effective Jan. 18.

USACE Issues PLA Surveys for Kentucky and Arizona

The U.S. Army Corps of Engineers (USACE) is requesting comments from the construction community addressing the potential use of Project Labor Agreements (PLAs) on large scale construction projects exceeding $25 million in Kentucky and Arizona.

Right to Work Law Signed in Michigan

ABC commended Michigan Gov. Rick Snyder (R) and lawmakers on Dec. 11 after he signed into law a new Right to Work bill that will protect workers in the state from being forced to pay union dues as a requirement of employment.

Appeals Courts Hears Oral Arguments on NLRB Recess Appointments

A federal appeals court in Washington, D.C., heard arguments Dec. 5 in one of 14 lawsuits on whether President Obama violated the Constitution in January when he made recess appointments to fill three NLRB vacancies while the Senate was in session.

House Republicans Support Blocking NLRB Notice Posting Rule

Twenty Republicans from the U.S. House of Representatives Dec. 5 filed an amicus brief in a federal appeals court in support of efforts to overturn an NLRB regulation that would require employers to post a notice displaying a biased list of employee rights under the NLRA.

NAVFAC and USACE Issue PLA Surveys for Maryland and California Projects

The Naval Facilities Engineering Command (NAVFAC) and the U.S. Army Corps of Engineers (USACE) are requesting comments from the construction industry about the potential use of government-mandated project labor agreements (PLAs) on two large-scale federal projects in Maryland and California.
