ABC Supports EPA’s Affordable Clean Energy Proposal

On Oct. 31, ABC submitted comments to the Environmental Protection Agency in support of the Affordable Clean Energy proposed rule, officially titled Emission Guidelines for Greenhouse Gas Emissions From Existing Electric Utility Generating Units; Revisions to Emission Guideline Implementing Regulations; Revisions to New Source Review Program. If finalized, the ACE rule would replace the Obama administration’s Clean Power Plan with revised emissions guidelines, propose new regulations to direct both EPA and the states on the implementation of emission guidelines and revise the New Source Review program.  Read the rest of entry »

OSHA Issues Guidance on Crane Operator Qualification Compliance

On Nov. 5, the Occupational Safety and Health Administration issued guidance on how to comply with crane operator certification requirements until OSHA’s new final rule on operator certification and qualification becomes effective. ABC Government Affairs Visits Arizona in Advance of Election Day

Last week, ABC government affairs staff traveled to the Grand Canyon state to visit members of the Arizona Builders Alliance. Trump Administration Releases 2018 Fall Regulatory Agenda

On Oct. 17, the Trump Administration released its Fall 2018 Regulatory Plan and Unified Agenda of Regulatory and Deregulatory Actions. The agenda lists upcoming rulemakings and other regulatory actions from each agency that the administration expects to publish through the end of the year and in 2019. Read the rest of entry »

Proposal Would Expand Access to Health Reimbursement Arrangements

On Oct. 23, the U.S. Departments of Labor, Treasury and Health and Human Services jointly issued a proposed rule, Health Reimbursement Arrangements and Other Account-Based Group Health Plans, that seeks to expand the availability of affordable health insurance for hardworking Americans by increasing the usability of health reimbursement arrangements. DOL Extends PAID Program for Six Months

On Oct. 9, the U.S. Department of Labor’s Wage and Hour Division announced a six-month extension to its overtime and minimum wage compliance initiative, the Payroll Audit Independent Determination program. According to a WHD news release, the PAID program helps workers receive more back wages due in an expedited manner, without having to wait for lengthy investigations to conclude or court cases to resolve. ABC Comments on OSHA’s Electronic Injury Reporting Proposal

On Sept. 28, ABC submitted comments to the Occupational Safety and Health Administration on its recent proposal to remove certain provisions of the 2016 Electronic Injury Reporting and Anti-Retaliation final rule, officially titled Improve Tracking of Workplace Injuries and Illnesses. Leading into November Elections, House Passes Tax Reform 2.0

On Sept. 27 and 28, the U.S. House of Representatives passed three bills (H.R. 6757, H.R. 6756 and H.R. 6760) that comprise the Tax Reform 2.0 package. ABC key voted these three bills and appreciates the important work of the House in moving these bills forward and building on the successes of the Tax Cuts and Jobs Act. These bills now move to the Senate, where their fate will likely be determined after the November elections by whichever party is in control of the Congress in 2019.  Read the rest of entry »

The Latest on WOTUS: Legal Action and Upcoming Rulemakings

In February 2017, President Trump signed an executive order directing the U.S. Environmental Protection Agency and U.S. Army Corps of Engineers to review the 2015 final Clean Water Rule: Definition of "Waters of the United States," also known as the WOTUS final rule, and accordingly revise or rescind it through public comment.
