The Office of Information and Regulatory Affairs at the Office of Management and Budget has concluded its review of the OSHA COVID-19 Vaccination and Testing Emergency Temporary Standard rulemaking, which will apply to employers with 100 or more employees as required by President Biden’s Path Out of the Pandemic COVID-19 Action Plan. This means that OMB is no longer holding meetings on the OSHA ETS and it could be released at any time.  Neither OMB nor DOL have made the contents of the ETS public. Once the ETS is published in the federal register as an interim final rule, it will be effective immediately in states where OSHA has direct jurisdiction.

ABC is philosophically opposed to federal mandates that undermine the desired policy outcome and plans to be fully engaged in the forthcoming OSHA ETS rule as well as consider a legal challenge. ABC will also provide further details as soon as the COVID-19 Vaccination and Testing ETS is published in the federal register.
