ABC is encouraging all members to take action and submit comments to the Department of Labor (DOL) on its proposal to rescind the "persuader" rule, officially named the "Interpretation of the 'Advice' Exemption in Section 203(c) of the Labor-Management Reporting and Disclosure Act." The final rule, had it gone into effect, would have had a profound, chilling effect on labor relations advice for employers, and in turn deprived employees of their right to obtain balanced information about union representation. ABC and its members have consistently opposed the rulemaking since it was first proposed in 2011. On Nov. 16, 2016, U.S. District Court for the Northern District of Texas permanently blocked the DOL's persuader rule. ABC's lawsuit against the final rule, filed in the U.S. District Court for the Eastern District of Arkansas, remains pending. ABC National will be filing comments by the August 4 deadline.
